Brazilian President sanctions the new Civil Procedure Code March 16th, 2014
President Dilma Rousseff sanctioned on Monday, March 16th at 3:00 PM, the text of the New Brazilian Code of Civil Procedure, approved by Congress last December.
Prepared by a committee of legal experts, the text promises to expedite prosecution of court proceedings, bringing more equality to decisions rendered in similar cases and improving cooperation between the parties, judges and attorneys. The Code of Civil Procedure, in its essence, governs deadlines, appropriate appeals and how the judges and the parties must conduct themselves in the course of civil lawsuits, which includes Intellectual and Industrial Property litigation. The current Brazilian Code of Civil Procedure (Law no. 5,869/1973) was in force for 42 years. |
